Permissible Use. Unless you are a real estate professional acting in your professional capacity, you agree to use the Services for your personal use, and your commercial use is limited to transactions done on your own behalf. The commercial use of real estate brokers is limited to providing information to consumers via the Services or, where authorized, taking actions on behalf of a consumer client (e.g., post a storage facility for sale). The Services may be used only for the sale of commercial storage facilities and services related to the management of such facilities. Subject to the restrictions set forth in the following paragraphs, you may copy information from the Services only as necessary for your personal use to view, save, print, fax and/or e-mail such information.
Restrictions and Additional Terms. You agree not to remove or modify any copyright or other intellectual property notices that appear in the Services.
Calls. If you, as a consumer, choose to contact a real estate broker through the Services by filling out a contact request or other request form on PLS, you authorize PLS to provide your name and contact information and other identifying information you provide to the real estate broker you choose.
You agree that PLS shall have the right to use Submissions and other information submitted to it for any purpose, including without limitation for publication of all or part of such Submissions on the Internet for unrestricted use by users of the PLS website and partners. PLS shall have sole authority to choose the manner in which any Submission will be received and displayed, and reserves the right to remove all or any part of a Submission at any time in its sole discretion. PLS shall have no obligation to monitor or verify the accuracy or proper use of any Submission. PLS reserves the right to modify or change any and all terms and conditions at any time.
Anyone who identifies himself or herself as a real estate broker or agent on the PLS website registration form or otherwise purports to be a real estate broker hereby represents and warrants that he or she is validly licensed as a real estate broker and is in compliance with applicable real estate broker requirements in all jurisdictions in which he or she is required to be licensed. PLS may, in its sole discretion, but without any obligation to verify the licensure of such individual as a real estate broker or agent, remove from the list of real estate brokers any person whom PLS believes is not a licensed real estate broker or agent in any applicable jurisdiction. PLS may, in its sole discretion, terminate the accounts of, and refuse services to, any person who repeatedly or knowingly misrepresents its licensed real estate broker or agent status or upon notification by any state agency or similar governmental authority that such person is not a licensed real estate broker. PLS does not and shall not have any obligation to independently verify the licensure of individuals identified as real estate brokers and agents on the PLS website. It is your responsibility to confirm the licensed status of any real estate brokers listed on the PLS website
The Role of PLS. PLS does not broker real estate transactions. PLS does not act as a real estate broker for you or any other user. PLS does not sell, buy, or negotiate the purchase, sale, or exchange of real property.
Linked Materials and Third-Party Materials. The Services include links to third-party products, services and websites, as well as materials provided by third parties. PLS does not endorse, and takes no responsibility for such products, services, websites, and materials. You understand that PLS has no obligation to, and generally does not, approve or monitor materials provided by third parties through the Services. Your dealings with any third party arising in connection with the Services are solely between you and such third party, and PLS takes no responsibility for any damages or costs of any type arising out of or in any way connected with your dealings with these third parties.
Claims of Copyright Infringement. PLS respects the intellectual property rights of others, and asks that everyone using the Services do the same. Anyone who believes that their work has been reproduced on the Services in a way that constitutes copyright infringement may notify PLS’ copyright agent in accordance with Title 17, United States Code, Section 512(c)(2), by providing the following information: (i) Identification of the copyrighted work that you claim has been infringed; (ii) Identification of the material that you claim is infringing and needs to be removed, including a description of where it is located on the Services so that the copyright agent can locate it; (iii) Your address, telephone number, and, if available, e-mail address, so that the copyright agent may contact you about your complaint; and (iv) A signed statement that the above information is accurate; that you have a good faith belief that the identified use of the material is not authorized by the copyright owner, its agent, or the law; and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf in this situation. If you give notice of copyright infringement by e-mail, PLS’ copyright agent may begin investigating the alleged copyright infringement; however, we must receive your signed statement by mail or as an attachment to your e-mail before we are required to take any action.
Intellectual Property. The Services are the property of PLS, and subject to the intellectual property rights of PLS and its licensors. You may not use any of PLS’ trademarks as part of your screen name or email address on the Services. The names of actual companies, products, and services mentioned herein may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved. PLS does not assert copyright or grant any rights to the underlying images or descriptions of real estate listings provided through the Services. Any use of these images and descriptions is subject to the copyright owner's permission and/or the requirements of applicable law.
NO WARRANTY. PLS PROVIDES THE SERVICES “AS IS,” “WITH ALL FAULTS” AND “AS AVAILABLE,” AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLS AND ITS SUPPLIERS MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. PLS AND ITS SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY AND IMPLIED, INCLUDING WITHOUT LIMITATION (A) WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, ACCURACY, TITLE, QUIET ENJOYMENT, NO ENCUMBRANCES, NO LIENS AND NON-INFRINGEMENT, (B) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING OR USAGE OF TRADE, AND (C) WARRANTIES OR CONDITIONS OF UNINTERRUPTED OR ERROR-FREE ACCESS OR USE.
